The Stet Collective, LLC Terms of Use

This Terms of Use Agreement (“Terms of Use”) is between The Stet Collective, LLC (hereinafter “TSC”) and the User (“user,” “you,” “your”).  These Terms of Use apply to TSC’s websites available at (1) https://www.thestetcollective.com; and (2) any other website or mobile applicate to which these Terms of Use are attached (collectively the “sites”). By using the Sites, you agree to be bound by these Terms of Use and to use the Sites in accordance with these Terms of Use, the Privacy Policy, and any additional terms and conditions that may apply to specific section of the Sites or to products and services available through the Sites or from TSC.  Accessing the Sites, in any manner, whether automated or otherwise, constitutes use of the Sites and your agreement to be bound by these Terms of Use.

 

INTELLECTUAL PROPERTY RIGHTS

 

Limited License

 

This Sites and all the materials available on the Sites are the property of TSC and/or our affiliates or licensors, and are protected by copyright, trademark, and other intellectual property laws. The Sites are provided solely for your personal noncommercial use. You may not use the Sites or the materials available on the Sites in a manner that constitutes an infringement of TSC’s rights or that has not been authorized by it. More specifically, unless explicitly authorized in these Terms of Use or by the owner of the materials, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit or distribute in any manner or medium (including by email or other electronic means) any material from the Sites. You may, however, from time to time, download and/or print one copy of individual pages of the Sites for your personal, non-commercial use, provided that you keep intact all copyright and other proprietary notices.


 

Submitted Material

 

By posting or submitting any material (including, without limitation, comments, blog entries, photos and videos) to TSC via the Sites, you are representing: (i) that you are the owner of the material, or are making your posting or submission with the express consent of the owner of the material; and (ii) that you are eighteen years of age or older. In addition, when you submit or post any material, you are granting TSC, and anyone authorized by it, a royalty-free, perpetual, irrevocable, non-exclusive, unrestricted, worldwide license to use, copy, modify, transmit, sell, exploit, and create derivative works from, distribute, and/or publicly perform or display such material, in whole or in part, in any manner or medium, now known or hereafter developed, for any purpose. The foregoing grant shall include the right to exploit any proprietary rights in such posting or submission, including, but not limited to, rights under copyright, trademark, service mark, or patent laws under any relevant jurisdiction. Also, in connection with the exercise of such rights, you grant TSC, and anyone authorized by it, the right to identify you as the author of any of your postings or submissions by name, email address, or screen name, as it deems appropriate.

 

You acknowledge and agree that any contributions originally created by you for TSC shall be deemed a “work made for hire” when the work performed is within the scope of the definition of a work made for hire in Section 101 of the United States Copyright Law, as amended. As such, the copyrights in those works shall belong to TSC from their creation. Thus, TSC shall be deemed the author and exclusive owner thereof and shall have the right to exploit any or all of the results and proceeds in any and all media, now known or hereafter devised, throughout the universe, in perpetuity, in all languages, as TSC determines. In the event that any of the results and proceeds of your submissions hereunder are not deemed a “work made for hire” under Section 101 of the Copyright Act, as amended, you hereby, without additional compensation, irrevocably assign, convey and transfer to TSC all proprietary rights, including without limitation, all copyrights and trademarks throughout the universe, in perpetuity in every medium, whether now known or hereafter devised, to such material and any and all right, title and interest in and to all such proprietary rights in every medium, whether now known or hereafter devised, throughout the universe, in perpetuity. Any posted material which are reproductions of prior works by you shall be co-owned by TSC.

 

You acknowledge that TSC has the right but not the obligation to use and display any postings or contributions of any kind and that TSC may elect to cease the use and display of any such materials (or any portion thereof), at any time for any reason whatsoever.


 

The Digital Millennium Copyright Act

 

The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under the U.S. copyright law. If you believe in good faith that materials hosted by TSC infringe your copyright, you, or your agent may send to TSC a notice requesting that the material be removed or access to it be blocked. Any notification by a copyright owner or a person authorized to act on its behalf that fails to comply with requirements of the DMCA shall not be considered sufficient notice and shall not be deemed to confer upon TSC actual knowledge of facts or circumstances from which infringing material or acts are evident. If you believe in good faith that a notice of copyright infringement has been wrongly filed against you, the DMCA permits you to send to TSC a counter-notice. LINKS TO THE SITES

 

You may establish a hypertext link to the Sites so long as the link does not state or imply any sponsorship of your website by TSC or by the Sites. However, you may not, without TSC’s prior written permission, frame or inline link any of the content of the Sites, or incorporate into another website or other service any of TSC’s material, content or intellectual property.

 

DISCLAIMERS

 

Throughout the Sites, TSC may provide links and pointers to websites maintained by third parties. TSC’s linking to such third-party websites does not imply an endorsement or sponsorship of such websites, or the information, products or services offered on or through the websites. In addition, neither TSC nor affiliates operate or control in any respect any information, products or services that third parties may provide on or through the Sites or on websites linked to by TSC on the Sites.

 

All information and services provided through the Sites, whether presented in a blog, membership, virtual one-on-one or group coaching, or other medium, is for informational purposes only and designed for your general education when using the Sites. It is not, nor is it intended to be, professional medical, mental health or coaching advice, or a substitute for the same. Engagement with the materials on the Sites does not create a coach-client relationship. You nevertheless recognize that your ultimate success or failure will be the result of your own efforts, your situation, and the innumerable other circumstance beyond the knowledge and/or control of TSC.

Thus, the results obtained by others – whether clients or customers of TSC, podcast listeners or guests, or users of the Sites – applying the principles set out in on the Sites are not guarantee that you or any other person or entity will obtain similar results.

 

All sales are final, and TSC does not offer any money-back guarantees. You recognize and agree that you shall not be entitled to a refund for any purchase under any circumstances.


 

LIMITATION OF LIABILITY

 

In no event shall TSC, its contributors, authors or advisors be liable for any damages (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits or damages resulting from lost data or business interruption) resulting from the use of or inability to use TSC’s Sites, its content, or the use of any product, information, idea, service or instruction contained in the information provided on the Sites, whether based on warranty, contract, tort or any other legal theory, and whether or not TSC its contributors, authors, advisors, members and affiliate organizations are advised of the possibility of such damages.


 

ASSIGNMENT

 

These Terms of Use shall be binding upon and inure to the benefit of TSC and its respective assigns, successors, heirs and legal representatives. Neither these Terms of Use nor any rights hereunder may be assigned without the prior written consent of TSC. Notwithstanding the foregoing, all rights and obligations under these Terms of Use may be freely assigned by TSC to any affiliated entity or any of its wholly owned subsidiaries.


 

GOVERNING LAW

 

These Terms of Use shall be governed by and construed in accordance with the laws of the State of New York and any dispute shall be subject to binding arbitration in New York City, New York. If any provision of these Terms of Use shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.


 

CHANGES IN TSC TERMS OF USE

 

TSC reserves the right to make changes to these Terms of Use at any time and for any reason without prior notice. Any changes to these Terms of Use will be posted on this page so that you are always aware of TSC’s current Terms of Use. It may also contact you by email with changes. Additionally, it will update the “last updated” date below.

Your privacy is important to The Stet Collective, LLC. Please read this privacy notice carefully as it contains important information on who we are, how and why we collection, store, use, and share personal information, your rights in relation to your personal information and on how to contact us and supervisory authorities in the even you have a complaint.

 

1. WHO WE ARE

 

The Stet Collective, LLC (doing business as The Stet Collective) collects, uses and is responsible for certain personal information about you.

 

2. CHILDREN’S ONLINE PRIVACY PROTECTION ACT

 

This website and any products and services offered herein are not intended for persons under the age of 13. The Stet Collective, LLC does not knowingly collect information from anyone under 13 years of age. The Stet Collective, LLC prohibits children under the age of 13 from using all interactive portions of this website, including leaving any comments, filling out forms, or otherwise submitting information. The Stet Collective, LLC will not knowingly collect personally identifiable information from children under 13. If The Stet Collective, LLC learns it has any information or content from anyone under the age of 13, it will delete that information.

The Stet Collective, LLC may collect, use, and is responsible for certain personal information that you provide when you voluntarily sign up for e-mails or giveaways, register for a program, leave comments, order a service or product, fill out any type of form, attend a retreat, access private membership pages, or otherwise contact The Stet Collective, LLC via an online form or e-mail. The information collected may include your name, e-mail, address, phone number, and/or billing information. You are not required to provide any personally identifiable information to merely access or visit this website. 

 

The Stet Collective, LLC may collect domain information and “cookies” (small files saved on your hard drive by your web browser) to analyze website and advertisement performance, track user patterns, save information from your previous visits and customize your experience.  We will ask for your consent to allow us to use cookies.  The Stet Collective, LLC or its third-party vendors may collect nonpersonal information through the use of these technologies. Non-personal information might include the browser you use, the type of computer you use and technical information about your means of connection to this website such as the operating systems and the Internet service providers utilized and other similar information. The Stet Collective, LLC’s systems may also automatically gather information about the areas you visit and search terms you use on this website and about the links you may select from within this website to other areas of the Internet.

We may also obtain name, email address, and other information from other sources, such as Google forms, Surveymonkey, Ontraport, Leadpages, Deadlinefunnel, Paypal, and Jotform.

 

c. How We Use Your Personal Information

 

The Stet Collective, LLC collects such information in order to send e-mails, fulfill orders, deliver services and products, complete customer transactions, oversee contests and promotions and improve website performance and customer service.

 

d. Who We Share Your Personal Information With

 

The Stet Collective, LLC respects your privacy and will never sell, trade or transfer your personally identifiable information to third parties (beyond what is necessary for fulfilling a customer transaction or for the basic functionality of an online service) without your consent.

 

We do, however, share your name and delivery address details with third-party suppliers (if you purchase any merchandise), and we share payment information with third-party credit card processors such as Paypal and Stripe.

 

This data sharing enables delivery of the goods you ordered and processing of any purchases you make.. The Stet Collective, LLC may release personal information to enforce its Website Terms and Conditions of Use, other Terms and Conditions, manage its business, protect users or the general public, or to otherwise comply with legal obligations.

 

If you give The Stet Collective, LLC your permission, it may also use personal identification information for internal or external marketing and promotional purposes.

 

On occasion, The Stet Collective, LLC may collect personal identification information from you in connection with optional contests, special offers or promotions. The Stet Collective, LLC will share such information with necessary third parties for the purpose of carrying out the contest, special offer or promotion. We will ask for your consent to such disclosure and use of such information, prior to your participation in the contest, special offer or promotion.

 

We will not share your personal information with any other third party.

 

e. Whether Information Has to Be Provided by You and Why

 

The provision of name and email address is required from you to enable us to add you to our email list. Your payment information is required from you to enable us to provide our paid services. Your mailing address is required from you to enable us to ship any physical goods you purchase. We do not require you to provide any personal data in order to view our website. We will inform you when we collect it whether you are required to provide the information to us.

 

f. How Long Your Personal Information Will Be Kept

 

We will hold all non-client personal data until you let us know you would like for us to delete it or unsubscribe from our marketing contacts, which you are free to do at any time. 

 

We will hold all client and customer personal data in our files for a minimum of six (6) years, or if you participate in any recorded video or other coaching call or post comments or information to any website or third-party forum operated by The Stet Collective, LLC, as long as that website or third-party forum remains available. 

 

g. Reasons We Can Collect and Use Your Personal Information

 

The Stet Collective, LLC collects and uses your personal information to further the following legitimate interests: to send e-mails, fulfill orders, deliver services and products, complete customer transactions, oversee contests and promotions and improve website performance and customer service.

 

4. USE AND TRANSFER OF YOUR INFORMATION OUT OF THE EEA

 

This website is operated in the United States and third parties with whom we might share your personal information as explained above are also located in the United States. If you are located in the EEA or elsewhere outside of the United States, please be aware that any information you provide will be transferred to the United States.
